- The DRUGS AND COSMETICS ACT, 1940 :
- The DRUGS AND MAGIC REMEDIES (objectionable advertisements ) Act, 1954 :
The drugs and cosmetics act,1940, regulates the manufacture , import , distribution and sale of drugs and cosmetics.
The drugs and magic remedies act, 1954 , allows the assessments of advertisements or promotional material of any kind that tries to sell medicines and remedies on the basis of magic and miracle.
According to SCHEDULE (J) of DRUGS AND COSMETCS ACT, no medicines will be made to claim to prevent or cure the list of 51 diseases which are mentioned in the list.
Despite of having legislations meant for protecting the common man and consumers against the misleading and false advertisements, still there are advertisements with false claims and without any evidence.
When the analysis of 82 advertisements were done it revealed shocking results that those advertisements were about sexual pleasure , menstrual problems , arthritis , hair problems , slimming , weight loss , infertility in males , enlargement of breasts , height gain and leucoderma .
Out of these 82 advertisements , 77 violated drugs and magic remedies act and provisions of schedule (j) of drugs and cosmetics act.
Hence , it was concluded that,"drugs advertised are false claims without having any evidence".
Those diseases which are listed in schedule (j) of the drugs and cosmetics act for which no one should claim to cure or advertise a cure.
The press and media and some times even the celebrities endorse the misleading advertised products. So, the government should take appropriate action against such types of advertisements which plays with the health of innocent people.

A study was conducted to analyse the advertisements on medicines and treatments appearing in the newspapers of India. The truthfulness and rationality of the various advertisements in different newspapers were checked in these newspapers . The violation of the laws were also asessed.
In this study , a cross sectional methodology was employed , in which advertisements appearing from September 2012 to November 2012 were taken for study. These advertisements were taken from 10 English and Hindi daily newspapers . These daily newspapers covers Northern and Southern India .The advertisements data was collected and analysed on the basis of two legislation .When the analysis of 82 advertisements were done it revealed shocking results that those advertisements were about sexual pleasure , menstrual problems , arthritis , hair problems , slimming , weight loss , infertility in males , enlargement of breasts , height gain and leucoderma .
